Agreement to these terms

These Terms of Service apply to your use of the Peckish website, waitlist, iOS app, ordering features, and restaurant-owner tools. By using Peckish or joining the waitlist, you agree to these terms and the Privacy Policy.

Eligibility

You must be at least 13 years old to use Peckish. If you are under the age of legal majority where you live, a parent or guardian must supervise your use. You must be legally able to enter a binding agreement and authorized to act for any restaurant account you create or manage.

Food allergy and safety information

  • Peckish may provide allergy-aware restaurant and menu context, but this information is not medical advice and is not a guarantee that food is free from allergens or cross-contact.

  • Peckish uses a user's caution setting to adjust how it presents restaurant and menu information based on available info. It does not predict a reaction or confirm that a restaurant can meet a user's needs. Call ahead to confirm. Informational support only.

  • Users are responsible for reviewing information carefully, using their own judgment, and communicating directly with restaurants when allergy-sensitive details matter.

  • Restaurants are responsible for the accuracy of menu, ingredient, kitchen-practice, and order-preparation information they provide.

Accounts and acceptable use

  • You must provide accurate information and keep account credentials secure.

  • You may not misuse Peckish, interfere with the service, scrape data, reverse engineer private systems, or attempt unauthorized access.

  • You may not submit false restaurant information, fake orders, abusive content, or information that violates another person's rights.

  • You may not use another person's health, allergy, emergency, payment, or account information without permission.

Reviews and other user content

  • You retain ownership of content you submit. You grant Peckish a nonexclusive, worldwide, royalty-free license to host, reproduce, format, moderate, and display that content only as needed to operate and promote the service.

  • Reviews must describe a genuine experience and may not contain threats, harassment, slurs, impersonation, undisclosed paid endorsements, private information, illegal content, or material you do not have permission to use.

  • Peckish may filter, hold for review, reject, remove, or restrict content and accounts under its moderation policies. Where public review features are enabled, users can report content and block review authors.

  • Restaurant replies are public content and must follow the same rules. Restaurant owners may not pressure users to remove honest reviews or offer undisclosed compensation for positive reviews.

Account suspension and termination

Peckish may limit, suspend, or terminate access when an account, listing, submission, or order appears fraudulent, abusive, unsafe, illegal, misleading, harmful to users, or in violation of these Terms. Users and restaurant owners may also request account deletion where available or by contacting Peckish support.

Orders, payments, and subscriptions

  • Food orders are purchases of physical goods from the selected restaurant. Peckish provides ordering and payment technology, while the restaurant is responsible for accepting, preparing, packaging, and fulfilling the order.

  • The checkout screen shows the item price, applicable taxes and fees, fulfillment method, and total before payment. Payment methods may include Apple Pay and cards processed by Stripe where enabled. Peckish does not store raw card numbers.

  • Preparation and pickup times are estimates, not guarantees. Verify the restaurant, pickup location, order details, and allergy context before placing an order.

  • Cancellation and refund availability depends on the order status, restaurant preparation, applicable law, and payment-provider rules. Contact Peckish promptly if an order is incorrect, missing, duplicated, unauthorized, or not fulfilled.

  • Digital iOS subscriptions or premium app features, if offered, use Apple's in-app purchase system. Restaurant business services and physical food orders use the payment method identified at checkout or in the owner agreement.

Restaurant-owner responsibilities

  • Restaurant owners and operators must keep listing, menu, ingredient, allergen, cross-contact, kitchen-practice, hours, pricing, fulfillment, and contact information accurate and current.

  • A restaurant must only upload menus, logos, photos, and other materials it owns or has permission to use.

  • Restaurants are responsible for food preparation, employee training, legal compliance, taxes, refunds they owe, order fulfillment, and direct communication with diners when confirmation is needed.

  • Peckish may review, correct, limit, suspend, or remove listings that are inaccurate, misleading, unlawful, or harmful to users.

Intellectual property

Peckish, its branding, designs, software, product experience, and related materials are owned by Peckish or its licensors. You may not copy, sell, or reuse Peckish materials except as allowed by law or written permission.

Third-party services

Peckish may link to or rely on restaurants, maps, authentication providers, payment processors, and other third-party services. Their terms and privacy practices may apply to their services, and Peckish does not control their independent operations.

Disclaimers and liability

Peckish is provided on an as-is and as-available basis. To the fullest extent allowed by law, Peckish disclaims implied warranties and is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the service, restaurant decisions, food preparation, user content, or third-party services. These terms do not limit rights or remedies that cannot legally be waived.

Governing law and disputes

These Terms are governed by Florida law, without regard to conflict-of-law rules. Unless applicable consumer law requires otherwise, disputes that are not resolved informally will be brought in state or federal courts serving Palm Beach County, Florida. Contact support first so Peckish has a reasonable opportunity to resolve the issue.

Changes to these terms

Peckish may update these Terms as the product develops. Continued use after updates means you accept the revised Terms. For support or general Peckish questions, email alecdevs@trypeckish.app.
